Welcome to The Smalltown Circus. These Terms and Conditions govern the your use of our facilities, website, classes, programs, events, memberships, and services. 

By registering for a class, purchasing a membership or package, booking a session, or entering our facility you agree to these Tems and Conditions and any applicable rules, policies, waivers, and safety requirements. 

  1. Eligibility

Participants must meet the age and ability requirements established for each class or program. Certain activities may have a minimum age, height, weight, skill-level, or other participation requirements. 

Participants under the age of 18 must have a parent or legal guardian complete all required registration forms, waivers, and consents. 

 

We reserve the right to determine whether a participant is appropriately suited for a particular class or activity based on safety considerations. 

2. Assumption of Risk

Activities included but not limited to aerial silks, aerial hammock, aerial hoop, acrobatics, and other class activities involve inherent risks. 

These risks may include falls, bruises, sprains, fractures, dislocations, muscle injuries, head injuries, and other serious injuries. 

By participating, you acknowledge that these activities involve inherent risks and you are voluntarily assuming those risks. 

Participant required completion of a Liability Waiver and Release. If a waiver is not completed, and you participate in a class, it is assumed that you agree to the conditions of the waiver. 

3. Health and Medical Conditions 

Participants are responsible for determining whether they are physically able to safely participate in our activities. 

You should consult with a qualified medical professional before participating if you have any medical condition, injury, pregnancy, recent surgery, or any other circumstances that may affect your ability to safely participate. 

You agree to inform instructors of relevant physical limitations or injuries that could affect your ability to participate.

Our instructors and staff are not medical professionals and cannot diagnose medical conditions of determine whether an ability is medically appropriate for you. 

3. Instructor and Safety Instructions 

 Participants must follow all resonable instructions provided by instructors and staff.

Our instructors or staff may refuse participation or remove a participant form an activity if that participant:

-is behaving unsafely

-is not following instructor instructions

-is beleived to be under the influence of drugs or alcohol

-is using equipment improperly

-poses a risk to themselves or others

-violated studio rules

No participant may attempt advanced skills, drops, inversions or other movements without instruction and authorization.

5. Equipment

Participants must use equipment only as instructed. Participants may not modify, move, adjust, install, or repair any equipment unless specifically authorized by The Smalltown Circus instructors. 

If you notice damaged, loose, or malfunctioning equipment, you must immediately notify an instructor or staff member and must not use that equipment. 

6. Classes, Reservations, and Scheduling

Advance registration may be required for classes and events. Class schedules, instructors, locations, and availability are subject to change. 

The Smalltown Circus reserves the right to cancel, reschedule, combine, or modfy classes when necessary, including because of instructor availability, facility issues, weather, emergencies, or insufficient enrollement.

Credit or refunds will NOT be given for missed classes, but absences/missed classes may be made up by attending other classes that is not full of equal or lesser value throughout the week. If the makeup class you choose to attend has more than 9 students in it, your student may not be allowed to join. Missed classes must be made up within the physical month. 

Students must obtain permission before switching into another class day. 

Privates are only available for students currently taking a class. We have found this is the best way for students to consistently grow and maintain their skills. 

7. Cancellations, No-Shows, and Late Policy

Our cancellation policy is intended to ensure that classes remain available to all members and participants.

If an instructor is unable to attend a class, private, or event they may cancel/reschedule that session and will endeavor to give you at lease 24 hour notices of cancellation, except when sudden illness or another emergency makes this not feasible. 

Unless otherwise stated in writing at the time of registration: 

Cancellations and no-shows may result in forfeiture of the class or booking fee. Repeated late cancellations or no shows may result in booking restrictions. 

Students that come in more than 5 minutes late may not be allowed to join class. 

Private lessons, workshops, events, and special programs may have different cancellation policies.  

8. Memberships

Memberships are subject to the membership terms presented at the time of purchase. 

Payment is due upon registration. All packages start on the 1st of the month. Current clients will receive an invoice due the 20th to reserve their spot in class for the next month. There is a $10 late fee if this invoice is paid late.

Members are responsible for keeping their payment information current. 

If a payment is declined or overdue, the membership may be suspended or the spot in class may be taken by another student. 

Membership cancellation, freezing, and suspension may also result in loss of place in class and loss of current discounts. 

9. Payments and Refunds 

Prices are displayed before purchase whenever possible. 

Unless otherwise required by applicable law, purchases are nonrefundable. 

Refunds, credits, transfers, and membership cancellations are subject to the specific terms presented at the time of purchase. 

The Smalltown Circus reserves the right to correct pricing or payment errors. 

10. Personal Belongings

Participants are responsible for their personal belongings. 

The Smalltown Circus is not responsible for lost, stolen, or damaged personal property.

11. Facility Rules

Participants must comply with all posted studio rules. 

The following may be prohibited:

-Harassment, bullying, or threatening behavior 

-Drug or alcohol on the premises

-unauthorized photography or recording

-misuse of studio equipment

-conduct that interferes with instructors, employees, or other participants

-Any behavior that creates any unreasonable safety risk

The Smalltown Circus reserves the rights to suspend or terminate access for violations of these rules.

12. Photography and Recording

Photography and recording may occur within the studio for educations, operational, promotional, or social media purposes. 

Where required by law, we will obtain appropriate consent before using an identifiable participant’s image for promotional purposes. 

Participants and spectators may not photograph or record other participants without their permission. 

If you do not wish to appear in promotional photographs or videos, please notify Smalltown Circus staff and note this on your waiver.

13. Children and Minors 

Parents and legal guardians are responsible for minors participating in Studio activities. Parents or guardians must complete all required forms and provide accurate emergency contact information. 

The Smalltown Circus may establish addition rules for minors, including supervision, pick up, waiting area, and participation requirements.   

14. Code of Conduct 

We are committed to maintaining a safe, respectful, and inclusive environment. 

Participants are expected to treat instructors, employees, and other participants resectfully. 

The Smalltown Circus has the right to suspend or termination participation for harassment, discrimination, threats, inappropriate conduct, or repeat violations of studio policies. 

15. Website and Online Services

You agree not to misuse our website, booking system, or online services.

You may not:

Attempt to grain unauthorized access;

interfere with the operation of our website;

upload malicious software;

use automated systems to improperly access our services; or

Use our content without permission

16. Intellectual Property

All studio logos, names, photographs, videos, written materials, graphics, website content, class materials, and other intellectual property belong to The Smalltown Circus or their respective owners. 

You may not reproduce, distribute, sell, or commercially use our materials without written permission.

17. Third Party Services

We may use third party services for payment processing, scheduling, email communications, website hosting, analytics, or other business functions.

Your use of those services may also be subject to the third party’s terms and policies.

18. Privacy

Our collection and use of Personal information is described in our Privacy Policy, which forms part of these Terms and Conditions

19. Limitation of Liability

In consideration of the risk of injury that exists while participating in The Smalltown Circus LLC hereinafter the “activity”); and the desire to participate in said Activity and being given the right to participate in same participants and their parents/guardians knowingly, and voluntarily waive any and all rights, claims or causes of action of any kind aririsning out of participation in the Activity, and release and forever discharge The Smalltown Circus LLC, their affiliates, manages, member, agents, staff, volunteers, (collectively “Releasees”), from any physical or psychological injury that I may suffer as a direct result of participation in the Activity. 

YOU ARE VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY ENTIRELY AT YOUR OWN RISK. YOU ARE AWARE OF THE RISK ASSOCIATED WITH PARTICIPATING IN THIS ACITIVY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO: PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, COVID EXPOSURE/CONTRACTION, AND DEATH. YOU UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY RISE FROM YOU OWN OR OTHERS’ NEGLIGENCE, CONDITIONS RELATED TO TRAVEL TO AND FROM THE ACTIVITY, OR FROM CONDITIONS AT THE ACTIVITY LOCATION(S), NONTHELESS, YOU ASSUME ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY. 

You further agree, to indemnity, defend and hold harmless the Releasees against any and all claims, suits, or action of any kind whatsoever for liability, damages, compensation or otherwise brought by my or anyone on my behalf, including attorney’s fees and any related costs. 

You further acknowledge that Releasees are not responsible for errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that you require medical care or treatment You authorize The Smalltown Circus LLC to provide all emergency medical care deemed necessary, including but not limited to first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. You further agree to assume all costs incurred as a result of such treatment. You are aware and understand that you should care your own health insurance. 

In the event that any damage to equipment or facilities occurs are a result of you or your family’s willful actions, neglect, or recklessness, you acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness. You agree to wear proper clothing and jewelry to prevent injuries to myself and equipment. 

You understand that you should not attempt the skills learned at The Smalltown Circus LLC or on any aerial apparatus on your own without instruction and supervision. 

 IN REGARD TO THE USE OF ONLINE SERVICES, THE SMALLTOWN CIRCUS, THEIR AFFILIATES, MANAGERS, STAFF, VOLUNTEERS, OR PARTNERS WILL IN NO EVENT BE HELD LIABLE FOR ANY INDIRECT ACIDENTAL, SPECIAIL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARAY DAMAGES RESULTING FROM THE ACCESS TO, THE USE OF, OR THE INABILITY TO USE THE ONLINE SERVICES, INCLUDING BUT NOT LIMITED TO UNAUTHORIZED ACCESS TO DATA, INCLUDING DMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE PROPERTY, EVEN IF THE SMALLTOWN CIRCUS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND ANY LIMITED REMEDY HAS FAILED ITS ESSENTIAL PURPOSE AND TO THE FULLEST EXTENT PERMITTED BY THE APPLICABLE LAW. IN THE EVENT THE SMALLTOWN CIRCUS IS FOUND LIABLE, ITS LIABLITY TO YOU IS LIMITED TO $100. 

In some jurisdictions the limitation or exclusion of liability are not permitted, so some limitations above may not apply to you, These limitations apply additionally to any damages incurred by any content posted by a third party or conduct of a third party using our services. You agree that The Smalltown Circus allows you to access and use the online services based on the allocation of risk and limitation of liability described herein.

20. Indemnification

You agree to indemnify and hold harmless the Releasees from any and all claims, liabilities, losses, damages, obligations, costs and expenses, including reasonable attorney fees and costs arising out of, relating to, or that may arise with you use of our services, user content provided by you or through use of your account, any actual or alleged violation or breach by you of these terms of use, any actual or alleged breach of any representation, warranty, or covenany that you have made to use, and your acts or omissions. You agree to fully cooperate with us in the defense of any cliam that is the subject of your obligations hereunder.

21. Revocation

The Smalltown Circus has the right at any time to cease access to online services or suspend any accounts. In the event that this occurs, it does not release you from your obligations to us under these terms of use. 

22. Dispute Resolution

In the event an issue arises please email thesmalltowncircus@gmail.com and send us a physical letter describing the issue. Our goal is to resolve issues amicably and efficiently. During the sixty days from the date we receive your Notice of Dispute, both parties agree to engage in good faith efforts to resolve the Dispute. During this sixty day period, both parties agree to toll any statutes of limitations that may apply, along with any filing deadlines.

We will consider reasonable requests to resolve a Dispute through alternative dispute resolution procedures, such as mediation or arbitration.

UNLESS OTHERWISE PROHIBITED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO A JURY TRIAL AND YOU AGREE THAT ANY AND ALL DISPUTES (WHETHER BASED IN CONTRACT, STATUTE, TORT OR ANY OTHER THEORY) WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. ALL CLAIMS MUST BE BROUGHT SOLELY IN A PARTY’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION, OR PROCEEDING.

To the fullest extent permitted by applicable law, you must assert any Dispute (by delivery of the Notice of Dispute) within one year after the Dispute arises, or it will be forever barred.

23. Changes to these terms 

We may update these Terms and Conditions from time to time. Updated terms will be posted on our website with a revised “Last Updated” date. Your continued use of The Smalltown Circus and our services after an update constitutes acceptance of the revised terms to the extent permitted by law. 

If any part of these Terms and Conditions is determined to be invalid or unenforceable, the remaining terms and conditions will remain in effect to the extent permitted by law. 

It is acknowledged that anything is writing supersedes word of mouth.

By registering for or participating in Studio activities, you acknowledge that you have read and agree to these Terms and Conditions.
